Below is a thorough breakdown of the PERM timeline, each with its own clock:

Prevailing Wage Determination

Before an employer can recruit for a position, it needs a Prevailing Wage Determination (PWD) from DOL's National Prevailing Wage Center on Form ETA-9141. This sets the minimum salary the sponsored role must pay, and every later stage of the PERM timeline builds on this number.

As of DOL's June 30, 2026 update, the National Prevailing Wage Center was processing OEWS-based wage requests filed in April 2026, and non-OEWS requests. This includes the private wage surveys, filed in March 2026. 

In practical terms, that puts most PWD determinations at roughly two to four months from filing, depending on which wage source applies to the role.

Recruitment and Quiet Period

Once the prevailing wage is finalized, the employer has to test the labor market. 

For professional occupations, this means a 30-day job order with the State Workforce Agency, two Sunday print advertisements, and three of ten additional recruitment steps DOL allows. This includes job fairs, campus recruiting, or a company career page posting.

Recruitment steps have to fall within a specific window. Usually no more than 180 days and no fewer than 30 days before the ETA-9089 is filed. 

That 30-day floor is the “quiet period,” and it exists to give U.S. applicants time to respond before the employer moves ahead. Filing before the quiet period closes is one of the more common reasons DOL returns or denies a case.

ETA-9089 Filing

The date the employer submits Form ETA-9089 (the actual PERM application), becomes the foreign worker's priority date. This date carries forward through the I-140 and, eventually, the green card application itself, which is why filing accuracy matters as much as filing speed.

Adjudication or Audit

From here, the application settles in one of two queues:

  • Majority cases go to standard Analyst Review.

For an unaudited case, the full labor certification processing time typically runs 14 to 18 months from the first PWD filing to certification.

During this stage, the application is examined by a DOL analyst to determine if the employer has complied with the labor certification requirements. The information provided in the application is reviewed, including the job requirements, offered wage, recruitment process, and other details relevant to the position. 

  • If everything is found to be in order, the application can be certified. 
  • If additional concerns are identified, an audit may be issued, with supporting documentation requested from the employer. 

As of the August 7, 2026 update, DOL adjudicated standard Analyst Review cases with a September 2025 priority date. The average processing time for determinations issued in July 2026 was 372 calendar days, slightly over twelve months. 

That average has come down from the 500-plus-day peaks reported earlier in 2026. Although it still means over a year between filing and a decision for most employers keen to know how long does PERM take once a case reaches DOL.

Current PERM labor processing time at this stage alone now exceeds what the entire period once took several years ago.

Audit Review Queue

If an application is selected for an audit, it is moved into the Audit Review Queue for additional examination by the DOL. During this stage, the employer is required to provide supporting documentation showing that the recruitment and labor certification requirements were properly followed. 

The submitted recruitment records, job requirements, and other evidence are reviewed before a determination is issued. 

  • If the audit response is accepted, the application can be certified. 
  • If the requirements are not satisfied, the application may be denied. 

Since an audit is reviewed separately from the standard Analyst Review process, additional processing time is added to the case. As a result, an audited application can remain with the Department of Labor considerably longer than a case that proceeds through standard review.

Reconsideration Requests

If DOL denies a case and the employer appeals, that appeal goes to a Certifying Officer for reconsideration. Once DOL certifies the ETA-9089, the clock changes completely. Everything up to this point moved in months. From here, it moves in days.

The 180-Day Filing Window for I-140

A certified PERM is valid for 180 days under 20 CFR 656.30(b), a timeline the USCIS Policy Manual confirms. The employer has that single window to file Form I-140 with the certified labor certification attached. There is no extension and no waiver if the window closes.

Miss the 180 days, and the labor certification expires outright. The employer cannot simply refile the I-140 late. Recruitment starts over, and the entire PERM timeline resets from the beginning.

  • The certification itself expires in exactly 180 days, regardless of whether the case was audited on the way to certification. 
  • Line up the I-140 filing, including ability-to-pay documentation and the beneficiary's qualification evidence, before the certification comes back. 

What Causes PERM Delays

Three factors account for most of the difference between a fast PERM and a slow one, and all three sit upstream of the DOL queue itself.

Audits

DOL has stated integrity checks for PERM applications. Common triggers include job requirements set above the industry norm for the occupation, a foreign-language requirement, an offered wage set well above the prevailing wage, and recent layoffs in the same or a similar occupation at the sponsoring employer.

None of these triggers are secret. Reviewing the ETA-9089 against them before filing is the single most effective way to keep a case out of the audit queue.

Supervised Recruitment

In more serious cases, the DOL does not stop at requesting documents. It orders the employer to redo recruitment under direct DOL supervision, including DOL-approved ad language and DOL-set timing. 

Supervised recruitment adds months to a case that was already running past a year. It also tends to carry a materially higher denial rate than a standard audit response.
