1. Agreement to Terms
These Terms & Conditions (“Terms”) are a legally binding agreement between you (“you” or “User”) and Beyond Border Global (“Beyond Border,” “we,” “us,” or “our”) governing your access to and use of https://www.beyondborderglobal.com and any related sites, portals, mobile experiences, or communications (collectively, the “Site”) and the services we provide (collectively, the “Services”).
By accessing or using the Site or Services, you agree to these Terms and to our Privacy Policy (linked on the Site), which is incorporated by reference. If you do not agree, then you are expressly prohibited from using the site and you must discontinue use immediately.
We may update these Terms at any time by posting an updated version and revising the “Last updated” date. Your continued use after changes are posted constitutes acceptance.
The Site is intended for users 18 years and older. You are responsible for compliance with all laws applicable to you when you access or use the Site or Services.
If you access the Site from any location outside your own jurisdiction, you do so on your own initiative and are solely responsible for complying with any local laws that apply. The Site is not designed to meet industry‑specific regulatory requirements (including HIPAA, FISMA, or similar). If your use would be subject to those laws, do not use the Site. You must not use the Site in any manner that would violate the Gramm‑Leach‑Bliley Act (GLBA). The Site is intended for individuals 18 years of age or older; persons under 18 may not use or register for the Site.
Important disclosures: Beyond Border Global is not a law firm and does not provide legal advice, and nothing on the Site or in our communications is legal advice. Blank immigration forms and instructions are available for free at the USCIS website. We are not affiliated with USCIS or any government agency. If you engage an attorney through our network, legal services are provided by independent attorneys under a separate attorney‑client agreement between you and the attorney, and communications with Beyond Border are not protected by the attorney‑client privilege.
We provide coordination, advisory, preparation, and case‑management services related to U.S. immigration filings, leveraging a network of independent attorneys who focus on employment‑based visas and green cards such as O‑1, L‑1, EB‑1, and EB‑2 NIW. We help collect information and documents, organize case materials, draft supporting packages for attorney review, and coordinate petition submission timelines. We do not guarantee outcomes because U.S. government agencies make final decisions. We do not represent you in court or before immigration authorities unless you separately retain an attorney who agrees to do so. We may decline or discontinue Services if we reasonably believe information is inaccurate or incomplete, or if proceeding would be unlawful or inappropriate.
Some features may require an account. You must provide accurate and current information and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly of any unauthorized use or suspected breach. We may suspend or terminate access for violations of these Terms or to protect our users, systems, or the public.
Fees and scope will be presented in an order form, engagement letter, invoice, or checkout flow (each an “Order”). Prices are in U.S. dollars unless stated otherwise and may exclude government filing fees, courier or postage, notary, translations, evaluations, travel, and other third‑party costs unless expressly included. You agree to pay the amounts due using permitted payment methods, and we may correct pricing or billing errors even after invoicing. Applicable sales, use, VAT, or similar taxes may be added and are your responsibility unless you provide a valid exemption. For any recurring or staged payments you authorize, you consent to automatic charges until canceled in accordance with the applicable Order.
Standard refund policy: Fees for Services are generally non‑refundable once work begins, except as expressly stated in a Service Agreement or in the guarantees below.
Money‑Back Guarantee (limited): If an Order expressly states a “Money‑Back Guarantee,” it applies only to the Beyond Border professional service fees for the specific petition type covered by the Order, and only if all of the following are true:
Any legal advice is provided solely by an attorney you separately retain under an attorney‑client agreement. Beyond Border does not supervise, control, or guarantee any attorney’s advice or professional judgment. We may receive fees from or pay fees to attorneys or service vendors for permitted administrative or marketing services, and any such arrangements will comply with applicable rules.
You agree to provide accurate, complete, and current information and to promptly update it as needed. You agree to review all filings and documents for accuracy before submission. You agree to comply with applicable laws and these Terms. You agree not to use the Site or Services for unlawful purposes or to submit false or misleading information. You agree not to interfere with security features or attempt to gain unauthorized access to systems or data.
You may not scrape, harvest, or systematically collect data from the Site without our written permission. You may not copy, distribute, or create derivative works from Site content except as allowed in Section 10. You may not upload or transmit malware, automated scripts, or content that disrupts the Site. You may not impersonate others, misrepresent your affiliation, or engage in fraud or abuse. You may not use the Site or Services to compete with us or for any revenue‑generating endeavor not authorized by us.
The Site and Services may reference or integrate third‑party services (e.g., translation, payments, e‑signature, shipping, credential evaluations) and external links. Your use of those services is governed by their terms and privacy policies. We do not endorse and are not responsible for third‑party content, services, failures, data practices, or security.
All content on the Site—including text, designs, software, compilations, photos, graphics, videos, and trademarks—are owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Site for your personal, non‑commercial use. Except as expressly permitted, you may not copy, modify, distribute, publicly display, or create derivative works from the Site or our materials without prior written consent. We reserve all rights not expressly granted.
If you submit feedback, suggestions, or ideas, you agree we may use them without restriction or compensation. If you submit content or materials to us (e.g., documents for your case), you represent you have the rights to do so and grant us the rights needed to provide the Services.
Your use of the Site and Services is subject to our Privacy Policy. By using the Site, you consent to the transfer and processing of your information in the United States and other countries where we or our service providers operate. Do not provide sensitive data unless we request it for your case; if you do, you consent to our processing of it to deliver the Services.
We may modify or discontinue any part of the Site or Services at any time. The Site may experience outages or interruptions. We have no obligation to maintain or support any specific feature.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, revenue, data, or goodwill, even if advised of the possibility. Our total aggregate liability for any claim arising out of or relating to the Site or Services will not exceed the amount you paid to Beyond Border for the specific Services giving rise to the claim during the 12 months preceding the event giving rise to liability. Some jurisdictions do not allow certain limitations; in those cases, the limitations will apply to the maximum extent permitted.
You agree to defend, indemnify, and hold harmless Beyond Border, its affiliates, officers, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Services; (b) your breach of these Terms; (c) your violation of law or third‑party rights; or (d) content or data you submit.
You consent to receive communications electronically and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirements that such communications be in writing. You consent to the use of electronic signatures and records.
These Terms are governed by the laws of the State of California without regard to conflict‑of‑laws rules. Before filing a claim, the parties will attempt to resolve disputes informally in good faith for 30 days after written notice. Except for claims that may be brought in small claims court or for injunctive relief, any dispute arising out of or relating to these Terms, the Site, or the Services will be resolved by binding arbitration administered by JAMS under its applicable rules. The seat and venue of arbitration will be San Francisco County, California, proceedings will be in English, and judgment on the award may be entered in any court of competent jurisdiction. Disputes will be conducted only on an individual basis, and no class, consolidated, or representative actions or arbitrations are permitted. Any claim must be filed within one year after it accrues.
You may not use the Site or Services if you are located in, under the control of, or a national or resident of any country or territory subject to comprehensive U.S. sanctions, or if you are on any U.S. government restricted party list. You are responsible for compliance with local laws.
We are not liable for delays or failures due to events beyond our reasonable control, including acts of God, natural disasters, war, strikes, governmental action, network or utility failures, or third‑party service interruptions.
If your complaint with us is not resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834; (800) 952‑5210 or (916) 445‑1254.
These Terms apply while you use the Site or Services. We may suspend or terminate access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site and Services ceases, but Sections intended to survive (including payment obligations, IP, warranty disclaimers, limitations of liability, indemnity, dispute resolution) will remain in effect.
Legal notices to Beyond Border may be sent to info@beyondborderglobal.com with the subject line “Legal Notice.” A physical mailing address may be provided upon request or in your Order. Notices to you may be delivered via email to the address associated with your account or provided during your engagement.
These Terms, together with any Order and our Privacy Policy, constitute the entire agreement between you and Beyond Border regarding the Site and Services and supersede prior agreements on the same subject. If there is a conflict between these Terms and an Order signed by you and Beyond Border, the Order controls for the conflicting subject matter. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Any failure to enforce a provision is not a waiver of that or any other provision. These Terms do not create a partnership, joint venture, or employment relationship.
Beyond Border Global is not a law firm and does not provide legal advice. We are not affiliated with the U.S. government or USCIS. USCIS forms and instructions are available for free at uscis.gov. Communications with Beyond Border are governed by our Privacy Policy and these Terms but are not covered by attorney‑client privilege. Any attorney‑client relationship is solely between you and the independent attorney you engage.
