How Does the H-1B Visa Stamping Process Work? 

For first-time H-1B holders entering the United States, your employer files the I-129 petition, USCIS approves it, and you, as the employee, apply for a visa stamp at the U.S consulate with the approval notice. 

For H-1B holders already in the United States with an extended petition, you only need to stamp your petition if you travel abroad. But it’s not a part of the extension process. 

You can only apply for a visa stamp after USCIS has approved the Form I-129 petition and issued an I-797 approval notice. With these, follow these three steps; 

  • Complete the DS-160 online nonimmigrant visa application at ceac.state.gov. The DS-160 covers employment details, employer information, role description, and travel history. Avoid any discrepancies in your DS-160 answers and the supporting documents. We recommend working with an experienced immigration specialist to prevent any avoidable errors. 
  • Pay the Machine Readable Visa (MRV) fee of $185 through the State Department portal. This is a non-refundable fee even if the visa is denied. If your appointment is cancelled or rescheduled, the MRV fee is valid for one year from the date of payment.
